These Terms of Service ("Terms") govern your use of merge-photos.com and related services operated by Merge Photos ("we", "us", or "our"). By using the website, you agree to these Terms.

1. Service description

Merge Photos provides a free, browser-based tool to create photo collages. You may use core features at no charge. Optional paid features unlock a high-resolution, watermark-free download for a specific collage, as described on our Pricing page.

2. Eligibility and acceptable use

You must have the legal right to upload and edit any photos you use. You agree not to:

• Upload unlawful, infringing, or harmful content;
• Attempt to disrupt, reverse engineer, or abuse the service;
• Use the service for spam, fraud, or automated scraping beyond normal use.

3. Your content

You retain ownership of photos you upload. You grant us a limited license to process, store, and display your content only as needed to operate the service (for example, generating a share link or preparing a download). You are responsible for backing up your own files.

4. Paid purchases

Paid HD downloads are sold as a one-time purchase per collage. Prices are shown on our Pricing page before checkout. Payments are processed by third-party payment providers (such as Creem or PayPal). We do not store full payment card details.

Except where required by applicable law, paid digital downloads are generally non-refundable once the watermark-free file has been delivered or made available for download.

5. Free and paid feature differences

Free downloads may include a visible site watermark and/or reduced resolution. Paid purchases remove the watermark and provide the highest export resolution available for that collage at the time of purchase.

6. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose or uninterrupted availability.

7. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for loss of data, profits, or goodwill arising from your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve (12) months before the claim, or USD $10 if you made no payments.

8. Changes and termination

We may update these Terms or modify features at any time. Continued use after changes constitutes acceptance. We may suspend access for violations of these Terms.

9. Governing law

These Terms are governed by applicable laws in the jurisdiction where the operator is established, without regard to conflict-of-law rules. Mandatory consumer protections in your country of residence still apply where required.
